Terms & Agreement

1. Seller and scope
These Terms & Agreement (the “Terms”) govern access to and use of the RS dVPN Core desktop software and related website checkout (the “Service”). The Service is operated by the independent RS dVPN Core project. Contact: rs.dvpn.core@gmail.com.
The paid plans are fees for access to and use of RS dVPN Core software features during the selected period. They are not a purchase of MYST, USDT, POL, VPN traffic, an exit node, a payment channel, or any third-party network service.
2. Independent software and third parties
RS dVPN Core is an independent software project. It uses TequilAPI and other publicly available interfaces to communicate with third-party infrastructure. RS dVPN Core is not affiliated with, endorsed by, sponsored by, or supported by Mysterium Network, Necto Labs, any node operator, wallet provider, exchange, bridge, RPC provider, or other third party unless expressly stated in a separate written agreement.
Third-party services are outside our control. This includes Mysterium Network, its TequilAPI-connected infrastructure, Mysterium nodes, node operators, routes, payment systems, identity services, and related network components. RS dVPN Core does not own, operate, supervise, verify, or control those nodes or operators and is not responsible for their availability, pricing, security, identity registration, payment processing, node quality, content, geographic availability, conduct, or terms.
We do not guarantee any particular Mysterium node, location, speed, anonymity, uptime, traffic quality, or uninterrupted access to Mysterium Network. Any dispute about a Mysterium node or third-party service must be directed to the relevant third-party operator or service provider.
3. Eligibility and acceptable use
You must have legal capacity to enter into these Terms and must comply with applicable law. You may not use the Service to breach sanctions, access systems without authorization, distribute malware, infringe rights, facilitate fraud, interfere with networks, or conduct unlawful activity.
You are solely responsible for your wallet, private keys, identity data, transactions, tax obligations, and all activity initiated through your wallet or client.
4. Plans, price and blockchain payment
The price and duration of each plan are displayed at checkout. The checkout currently uses USDT on the configured Polygon network. The smart contract transfers the configured payment to the configured treasury; the Provider does not custody customer funds between transactions.
A purchase requires a compatible wallet, sufficient USDT, and sufficient POL for network fees. Blockchain transactions are generally irreversible. Network fees, exchange fees, bridge fees, slippage, failed transactions, wrong-network transfers, and incorrect addresses are your responsibility and are not controlled by the Provider.
MYST is not accepted as payment for the software plan. MYST is a separate third-party network asset that may be needed to pay for traffic after the software purchase.
5. Digital service and withdrawal rights
The Service is digital content and/or a digital service supplied online. Before completing a purchase, a consumer may be asked to expressly request that access starts before the end of the statutory withdrawal period and to acknowledge the legal consequences of that request.
Nothing in these Terms removes or limits mandatory consumer rights under applicable law. Where the statutory conditions for loss or limitation of withdrawal rights are not met, the consumer retains the rights granted by law. Withdrawal, conformity rights, and complaints are handled in accordance with applicable consumer-protection rules.
To submit a withdrawal or complaint, contact rs.dvpn.core@gmail.com with the wallet address, transaction hash, plan, and a description of the request. Do not send private keys or seed phrases.
6. Software licence
Subject to these Terms and payment of the applicable plan, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the RS dVPN Core software for personal or internal lawful use during the plan period. You may not resell access, sublicense the software, circumvent technical restrictions, reverse engineer it except where mandatory law permits, or remove attribution and licence notices.
7. Availability, changes and security
We may update, suspend, limit, or discontinue features for maintenance, security, legal, technical, or business reasons. We will not knowingly exclude mandatory statutory remedies. You must keep your operating system, wallet, and client updated and should report suspected security issues to rs.dvpn.core@gmail.com.
The Service is provided without a guarantee that it will be uninterrupted, error-free, compatible with every device, or suitable for a particular purpose. Do not rely on the Service for emergency communications or critical infrastructure.
8. Liability
To the maximum extent permitted by law, the Provider is not liable for third-party services, node conduct, wallet or exchange failures, blockchain congestion, smart-contract behavior, wrong-network transfers, loss of private keys, loss of tokens, indirect loss, loss of profit, loss of data, or loss caused by unlawful use.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for intentional misconduct, personal injury, or mandatory consumer rights. For business customers to the extent permitted by law, the Provider’s aggregate contractual liability is limited to the fees paid for the affected plan during the six months preceding the event giving rise to the claim.
9. Data protection
We may process wallet addresses, transaction hashes, identity values, support messages, and technical data needed to provide the Service, prevent abuse, handle accounting, and comply with law. Blockchain data is public and may be difficult or impossible to delete. See the Privacy Policy for more information.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access for material breach, unlawful use, security risk, fraud, or where required by law. Termination does not affect accrued rights, statutory remedies, or obligations that by their nature continue after termination.
11. Governing law and disputes
These Terms are governed by applicable law. Mandatory consumer protections and the jurisdiction of the courts in the consumer’s place of residence remain unaffected. Other disputes will be handled by a competent court under the applicable procedural rules.
